Suwalska Karta KOMUNIKACYJNA – regulamin

§ 1. Stosowana terminologia:

1. PGK – Przedsiębiorstwo Gospodarki Komunalnej w Suwałkach Spółka z o.o., adres: ul. Sejneńska 82, 16-400 Suwałki, wpisana do rejestru przedsiębiorców prowadzonego przez Sąd Rejonowy w Białymstoku, XII Wydział Gospodarczy Krajowego Rejestru Sądowego pod numerem KRS 0000070127, będąca operatorem publicznego transportu zbiorowego w Suwałkach.
2. Suwalska Karta Komunikacyjna – zwana inaczej Kartą lub SKK, jest kartą z pamięciowym układem elektronicznym będącym nośnikiem biletów okresowych oraz innych usług.
3. Kontrakt (elektroniczny bilet okresowy) – zapis na SKK, uprawniający do przejazdów środkami publicznego transportu zbiorowego (autobusami komunikacji miejskiej), wykonywanego przez PGK zgodnie z obowiązującymi taryfami opłat oraz regulaminem przewozu. .
4. Kodowanie – elektroniczne zapisanie Kontraktu na SKK przez terminal kodujący.
5. COK – Centrum Obsługi Klienta i Personalizacji SKK, mieszczący się przy ul. Sejneńska 6D w Suwałkach (budynek administracji Zakładu Targowisk Miejskich).
6. POK – Punkty Obsługi Klienta i Personalizacji SKK prowadzące sprzedaż elektronicznych biletów okresowych.
7. Paragon – wydruk z terminala kodującego potwierdzający dokonanie transakcji zakupu Kontraktu, zawierający datę i godzinę transakcji, kod i opis zakodowanego biletu, cenę biletu, datę początku i końca ważności biletu, oznaczenie punktu sprzedaży i numer SKK.

§ 2. Składanie wniosku i wydawanie Karty

1. SKK jest kartą imienną i może być użytkowana przez osobę, której dane zostały zapisane na tejże Karcie.
2. Wnioskodawca otrzymuje SKK po złożeniu wniosku w COK.
3. Użytkownik może posługiwać się tylko jedną SKK.
4. Wniosek o wydanie Karty można pobrać w COK, w wybranych POK, na stronie internetowej PGK (www.pgk.suwalki.pl) i www.skk.suwalki.pl Wypełniony wniosek należy złożyć w COK, ul. Sejneńska 6D, 16-400 Suwałki.
5. Niekompletny i/lub błędnie wypełniony wniosek o wydanie SKK nie będzie rozpatrywany.
6. Istnieje możliwość zbiorowego wydawania SKK instytucjom lub grupom zorganizowanym, po wcześniejszym uzgodnieniu tego z PGK.
7. SKK wydana przez COK jest kartą aktywną, gotową do zapisania na niej Kontraktu.
8. Każdorazową zmianę danych osobowych (imię, nazwisko, adres) wnioskodawca zgłasza w COK celem uaktualnienia informacji zapisanych na SKK. Aktualizacja dokonywana jest po wypełnieniu przez wnioskodawcę wniosku oraz okazaniu pracownikowi COK dowodu tożsamości i SKK. Aktualizacja jest bezpłatna.

§ 3. Zasady kodowania biletów na Suwalskiej Karcie Komunikacyjnej

1. SKK może być nośnikiem dowolnego typu Kontraktu przewidzianego przez cennik opłat za przejazdy środkami publicznego transportu zbiorowego (autobusami komunikacji miejskiej), wykonywanego przez PGK..
2. Kodowanie odbywa się w odpowiednio oznakowanych punktach kodowania Suwalskiej Karty Komunikacyjnej: COK oraz POK.
3. Kodowanie przeprowadzane jest przez pracownika COK po uprzednim podaniu mu SKK.
4. W celu zawarcia Kontraktu pasażer informuje pracownika COK (POK) o rodzaju oraz okresie ważności biletu, jaki chce zakupić.
5. Urządzenie do kodowania SKK dokonuje elektronicznego zapisu Kontraktu.
6. Każdorazowo po zakodowaniu Kontraktu wydawany jest Paragon, który jest podstawą składania ewentualnych reklamacji.
7. W przypadku, gdy dzień rozpoczęcia ważności Kontraktu jest równocześnie dniem jego zakupu, Kontrakt jest ważny od godziny zakupu, wskazanej na Paragonie.

§ 4. Zasady kontroli Suwalskiej Karty Komunikacyjnej w autobusach komunikacji miejskiej

1. Kontrolę SKK mogą przeprowadzać wyłącznie osoby upoważnione przez PGK, wskazane w regulaminie przewozów.
2. SKK bez zakodowanego na niej ważnego Kontraktu, ani sam Paragon nie upoważniają do korzystania z przejazdów środkami publicznego transportu zbiorowego (autobusami komunikacji miejskiej), wykonywanego przez PGK.
3. Podczas kontroli, pasażer powinien (właściciel SKK bez zdjęcia) powinien posiadać dokument stwierdzający zgodność danych zapisanych na SKK.
4. W czasie kontroli pasażer zbliża SKK do czytnika kontrolerskiego w sposób umożliwiający odczytanie zawartości Karty, a także na żądanie kontrolera, okazuje dowód tożsamości potwierdzający prawo do użytkowania SKK oraz ewentualny dokument uprawniający do przejazdów ulgowych, zgodnie z obowiązującym wykazem osób i dokumentów uprawniających do bezpłatnych lub ulgowych przejazdów środkami publicznego transportu zbiorowego (autobusami komunikacji miejskiej), wykonywanego przez PGK i regulaminem przewozów.
5. Terminal kontrolerski odczytuje informacje o zakodowanych na SKK Kontraktach oraz dane osobowe użytkownika.
6. W przypadku stwierdzenia, że kontrolowany pasażer nie jest w stanie potwierdzić prawa do użytkowania SKK (niezgodność danych osobowych zapisanych na Karcie i w dowodzie tożsamości, brak dowodu tożsamości), kontroler ma prawo zatrzymać SKK i przekazać ją do wyjaśnienia PGK. Pasażerowi nakłada się opłatę dodatkową, zgodnie z zapisami cennika opłat i regulaminem przewozów.

§ 5. Zasady reklamowania Suwalskiej Karty Komunikacyjnej oraz anulowania Kontraktów

1. Reklamacje związane z funkcjonowaniem SKK można składać w COK na formularzu dostępnym w COK i na stronie internetowej PGK.
2. SKK z ujawnioną wadą fabryczną można bezpłatnie wymienić w COK.
3. Nie ma możliwości anulowanie Kontraktu na SKK lub innym nośniku biletu. Należy świadomie dokonywać zakupu biletów okresowych.
4. W przypadku rezygnacji z użytkowania SKK, PGK nie zwraca środków za niewykorzystane Kontrakty i inne usługi zakodowane na Karcie.
5. Utratę SKK (zagubienie, kradzież, zniszczenie) należy pisemnie lub osobiście zgłosić w COK. Karta utracona zostaje zablokowana. Klient otrzymuje duplikat SKK, który zawiera aktualny Kontrakt.

§ 6. Inne usługi kodowane na Suwalskiej Karcie Komunikacyjnej

1. W przypadku kodowania na SKK usług innych niż bilety za przejazdy środkami publicznego transportu zbiorowego, za ich kodowanie oraz realizację odpowiada podmiot sprzedający usługi.
2. Kodowanie innych usług nie wyklucza i nie zagraża korzystaniu z SKK jako nośnika biletów za przejazdy środkami publicznego transportu zbiorowego (autobusami komunikacji miejskiej).

§ 7.Zasady właściwego posługiwania się Suwalską Kartą Komunikacyjną

1. SKK nie wolno łamać, zginać lub w jakikolwiek sposób uszkadzać mechanicznie (np. dziurkując, obcinając).
2. SKK nie należy narażać na oddziaływanie wysokich i niskich temperatur (-20; +50), a także środków chemicznych, silnych pól magnetycznych lub elektrycznych.
3. SKK można bezpiecznie przechowywać i użytkować wraz z innymi kartami tego typu (np. z kartami płatniczymi).

TERMS AND CONDITIONS

for purchasing a season ticket in the Internet Passenger Portal

Scope of Application

§ 1

1. Based on Article 4 of the Act of November 15, 1984, Transport Law (Journal of Laws of 2024, item 1262), these Regulations for the online sale of tickets via the Internet Passenger Portal, hereinafter referred to as the e-portal Regulations, are established.

2. The e-portal Regulations define the rules and conditions for:

  • 1) electronic purchase of public transport tickets organized by the City of Suwałki;
  • 2) using the account and processing Passengers' personal data.

3. To purchase an electronic transport document, the Passenger is obliged to accept the provisions of the e-portal Regulations, thereby agreeing to the terms contained therein, which simultaneously constitutes a declaration of will and creates legal obligations between the Passenger and PGK in Suwałki Sp. z o.o., which is the operator in Suwałki's local public transport.

4. The Passenger may purchase transport documents for themselves and for third parties via the Internet Passenger Portal (hereinafter referred to as the e-portal). If they do so on behalf of a third party, it means they have a legally valid power of attorney. The Passenger bears full responsibility for acting without a power of attorney and in the event of exceeding its limits. The Passenger is responsible for financial obligations.

5. Instructions for using the e-portal are available on the website www.skk.suwalki.pl/ by clicking on the "Usage Instructions" link.

6. If the Passenger does not accept the presented conditions or does not meet the technical requirements, transactions in the e-portal are impossible.

Glossary of Terms and Meanings

§ 2

The terms used in the e-portal Regulations mean:

  • 1) Suwałki Communication Card (interchangeably: e-card or SKK) – an electronic ticket carrier used in Suwałki's city bus transport.
  • 2) Contactless payment card – a payment instrument issued by financial institutions, most often banks, enabling contactless payments.
  • 3) E-portal (Internet Passenger Portal) - an online sales service operating at www.skk.suwalki.pl.
  • 4) E-portal Regulations – these regulations.
  • 5) Passenger – any person using the e-portal.
  • 6) Agreement – an agreement for the purchase of a transport document concluded via the e-portal.
  • 7) PGK – Przedsiębiorstwo Gospodarki Komunalnej in Suwałki Sp. z o.o., which is the operator in Suwałki's city bus transport, to whom the City of Suwałki has entrusted the distribution of tickets for public transport (ul. Sejneńska 82).
  • 8) Passenger Service and SKK Personalization Point – a point at the municipal market at ul. Sejneńska 6D in Suwałki – administrative building from the ul. Utrata side.

Conditions for Concluding the Agreement

§ 3

1. Services provided within the e-portal constitute services provided electronically within the meaning of the Act on the provision of services by electronic means (Act of July 18, 2002, on the provision of services by electronic means (Journal of Laws of 2024, item 1513, as amended)).

2. The Agreement is concluded via the e-portal.

Payment

§ 4

1. After logging in to the e-portal to purchase an electronic transport document, the Passenger selects its type and period of validity.

2. The Passenger makes payments for services provided within the e-portal using one of the available payment methods:

  • 1) traditional bank transfer – requires entering a unique transaction code obtained in the e-portal in the transfer title;
  • 2) payment by payment card – performed via an electronic payment service provider;
  • 3) fast online payment – available in banks offering this type of service, performed via an electronic payment service provider.

3. The prices and types of electronic transport documents are specified in the applicable fare tariff, set by the City Council in Suwałki.

4. The ticket price is specified in Polish zloty (PLN) and includes VAT.

5. The list of possible payment methods and supported banks is updated regularly and made available on the website www.skk.suwalki.pl/.

6. Only one electronic transport document selected by the Passenger can be purchased with a single payment.

7. The crediting of funds to the settlement account indicated by PGK in the e-portal will be confirmed by an email sent to the Passenger's email address.

8. In the absence of payment confirmation by the electronic payment provider, the transaction is automatically canceled.

9. The electronic payment service provider is responsible for the execution and security of transactions.

10. PGK and the electronic payment service provider are not responsible for the consequences of the Passenger providing an incorrect payment card number or an incorrect bank account number.

11. The electronic payment service provider is not a party to the Agreement and is not otherwise covered by the legal consequences of the agreement concluded between the Passenger and the bank through which the online payment service is provided within the payment system.

12. The electronic payment service provider is not liable to the Passenger for the non-performance or improper performance of the obligation incumbent on the bank. In particular, it is not responsible for the bank's failure to transfer funds to the electronic payment service provider, at the correct time, in the correct amount, and with the correct data enabling their identification.

Issuance of VAT Invoices

§ 5

1. An electronic transport document is not a VAT invoice.

2. A VAT invoice is issued in electronic form and sent to the email address provided by the Passenger in the application.

3. To obtain a VAT invoice, during the purchase of an electronic transport document, use the "I want to receive an invoice" button, and then provide the invoice data.

4. If the "I want to receive an invoice" button is not used during the purchase, the Passenger has the option, within 7 days from the moment of purchasing the electronic transport document on the e-portal, to submit a completed VAT invoice request at the Passenger Service and SKK Personalization Point or to the email address: skk@pgk.suwalki.pl. The application can be obtained at the Passenger Service and SKK Personalization Point or downloaded from the e-portal website.

Passenger's Obligations

§ 6

1. The Passenger is obliged to:

  • 1) provide true and current data when using the e-portal;
  • 2) use the e-portal in accordance with the law and the provisions of these Regulations and good practices;
  • 3) not transfer rights resulting from the concluded agreement to third parties;
  • 4) not use the e-portal to commit unlawful acts.

2. By accepting the provisions of these Regulations, the Passenger acknowledges and declares that all information provided by them while using the e-portal, including personal data and data used for payment processing, are true and current and accurate to their best knowledge.

3. The Passenger's account may be blocked, and they may be liable for damages in the event of abuse of the account, e.g., actions inconsistent with the account's purpose or leading to its improper functioning, financial losses, or loss of revenue.

4. The Passenger declares that they are aware of the civil and criminal law consequences of actions inconsistent with the legal order in force in Poland and acknowledges that actions bearing the hallmarks of a punishable offense will be reported to the appropriate law enforcement authorities, which does not exclude seeking compensation through civil action.

Complaint

§ 7

1. The Passenger may submit a complaint within 14 days from the date of the event being the subject of the complaint.

2. Complaints can be submitted in writing:

  • 1) personally at the PGK headquarters;
  • 2) by post to the address: PGK in Suwałki Sp. z o.o., 16-400 Suwałki, ul. Sejneńska 82
  • 3) by email to the address: skk@pgk.suwalki.pl.

3. The subject of a complaint may be an irregularity or ineffectiveness of the electronic transport document purchase process conducted via the e-portal.

4. The basis for a complaint cannot be, in particular:

  • 1) the circumstance that the purchase concerns an e-card incorrectly indicated by the Passenger;
  • 2) referring to circumstances related to the improper functioning of the internet browser or telecommunication links;
  • 3) other circumstances related to the activities of entities for whose actions PGK is not responsible.

5. The complaint should contain the Passenger's data, including the correspondence address, e-card number, and a brief description of the reported reservations.

6. If the complaint contains formal deficiencies, PGK will request their completion within 7 days under penalty of rejection of the complaint.

7. The complaint will be examined within 15 business days from the date of its submission or the completion of formal deficiencies.

8. If it is impossible to process the complaint within the period indicated in paragraph 7, PGK will inform the Passenger about the expected deadline for responding to the complaint, indicating the reasons for the delay and the estimated response time, which may not exceed 35 business days.

Reservations

§ 8

1. PGK reserves the right to refuse, deny execution, or reject a transaction. In such a case, PGK will notify the Passenger of the refusal and its reason.

2. An incorrectly defined ticket purchase order or one whose confirmation is not possible may not be realized. In such a case, the paid funds will be returned to the bank account from which the payment was made.

3. PGK reserves the right to temporarily suspend access to the e-portal to carry out maintenance work.

4. PGK is not responsible for the non-performance or improper performance of obligations resulting from these Regulations if it results from the fault of the Passenger or a third party for whose actions PGK is not responsible, or occurred as a result of force majeure.

5. In the event of Force Majeure, the performance of the service will be suspended for its duration.

Withdrawal from the Agreement

§ 9

1. PGK has the right to withdraw from the Agreement in the event of the Passenger's violation of the provisions of the e-portal Regulations.

2. This right applies in particular if the Passenger provides false personal data, payment card data, or data provided for the purpose of a fast online transfer.

Personal Data Protection

§ 10

1. The administrator of Passengers' personal data, within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter referred to as GDPR, is PGK.

2. Passengers' personal data are processed by PGK in accordance with the provisions of applicable law, in particular GDPR, for the purpose of:

  • 1) concluding the Agreement, its implementation, and documenting its execution,
  • 2) handling complaints,
  • 3) fulfilling legal obligations incumbent on PGK,
  • 4) notifying the Passenger about the status of payment processing.

3. In connection with the provision of services, PGK collects the following personal data of Passengers:

  • 1) first name and last name,
  • 2) date of birth/PESEL
  • 3) email address,
  • 4) phone number,
  • 5) IP address,
  • 6) data of payment instruments used to use the service.

4. Providing personal data by the Passenger is voluntary, but it is necessary for the provision of services, and failure to provide this data may result in the inability to register and use the services.

5. Detailed rules for processing Passengers' personal data by PGK are available on the website at: https://www.pgk.suwalki.pl/2018/10/rodo/.

Changes to the e-portal Regulations

§ 11

1. The e-portal Regulations and all its changes are available on the e-portal website at: www.skk.suwalki.pl.

2. The Regulations may be changed by PGK at any time, without giving reasons.

3. All changes to the e-portal Regulations come into force no earlier than five days from their publication.

4. For agreements concluded during the change of the e-portal Regulations, the provisions that are in force on the date of crediting the Passenger's payment to the PGK account apply.

REGULATIONS

for paying fares on Suwałki public bus transport using ticket validators

Scope of Application

§ 1

Based on Article 4 of the Act of November 15, 1984, Transport Law (Journal of Laws of 2024, item 1262), these Regulations for paying fares on Suwałki public bus transport using ticket validators, hereinafter referred to as the Regulations, are established.

The Regulations specify the service conditions related to the use of a contactless payment card or another NFC-enabled device with contactless payments activated when paying fares on Suwałki public bus transport using ticket validators.

The Regulations apply within the City of Suwałki and in communes that have entrusted the City of Suwałki with the task of organizing public collective transport on lines connecting the City of Suwałki with selected communes, within the framework of inter-communal agreements concluded for the joint implementation of public collective transport.

Glossary of Terms and Meanings

§ 2

The terms used in these Regulations mean:

  • Regulations – these regulations.
  • Passenger – any person using the ticket validator.
  • PGK – Przedsiębiorstwo Gospodarki Komunalnej w Suwałkach Sp. z o.o. (Municipal Economy Enterprise in Suwałki Ltd.), which is the operator of Suwałki public bus transport, entrusted by the City of Suwałki with the distribution of tickets for public transport (ul. Sejneńska 82).
  • Contactless payment card / payment card / contactless card – a payment instrument issued by financial institutions, most often banks, enabling contactless payments. Whenever the Regulations refer to a contactless payment card / payment card / contactless card, this also includes other NFC-enabled devices with contactless payments activated (most often a phone).
  • Ticket Validator - a device enabling Passengers to activate tickets and pay fares on public bus transport using payment cards or the Suwałki Communication Card.
  • Fare Payment – the operation of bringing a payment card close to the ticket validator in the bus, preceded by selecting the appropriate ticket on the validator screen.
  • Ticket – a paper ticket, as well as a ticket purchased using payment cards or electronic devices.
  • Inspector's Terminal - a mobile device for checking payment cards.

Description of Ticket Validator Operation

§ 3

The ticket validator enables the Passenger to pay the fare on public bus transport using a contactless payment card.

In the front part of the ticket validator, there is a touch display module, which shows, in particular, the current date and time, as well as other information about the ongoing course and button fields.

On the ticket validator display, there are buttons for selecting individual single-ride tickets and 24-hour multi-ride tickets, as well as a button:

  • "Periodic Tickets" – a button enabling the purchase of ten-day and monthly tickets using a contactless payment card, provided their price does not exceed the contactless transaction amount that does not require PIN entry;
  • "Check ticket validity" – a button enabling checking the validity of any type of ticket (paper, on electronic information carriers).

The method of fare payment is specified in the Instructions for fare payment using ticket validators, available at: www.skk.suwalki.pl.

Selecting the fare payment option makes the ticket validator ready for approximately 5 seconds to deduct a one-time fee from a contactless payment card for the ticket according to the selected option. After placing the payment card, the appropriate fee is automatically deducted.

Successful fare payment with a payment card is confirmed by a message on the display and a single beep.

Moving the contactless payment card away from the ticket validator too quickly will result in the non-collection of the due amount. The terminal awaits the correct reading of the contactless card.

The ticket validator has a function to block fare payment by payment card. The validator block is activated by the inspector. The blocked status of the validator is indicated by the message on the display: "Blocked".

Rules for Purchasing Tickets Using a Contactless Payment Card

§ 4

The ticket validator deducts the fare from the payment card according to the ticket tariff established by the City Council in Suwałki.

During travel on the same bus, another fare payment can be made using the same payment card.

Rules for Checking Fare Payment Using the Ticket Validator

§ 5

Payment card checks may only be carried out by persons authorized by PGK, possessing an identification card issued by PGK, displayed in a visible place.

The inspecting person is equipped with an inspector's terminal.

During the inspection, the Passenger places the payment card against the inspector's terminal to verify that the fare has been paid.

Basic information about the fare payment is displayed on the inspector's terminal screen along with the inspection result.

In the absence of a registered fare payment, the inspecting person issues a demand for payment of an additional fee, in accordance with a separate resolution of the City Council in Suwałki.

Complaint Procedures

§ 6

Complaints regarding fare payment using the ticket validator are accepted exclusively in writing and require personal attendance at the SKK Passenger Service and Personalization Point (ul. Sejneńska 6D) during operating hours, in order to read the token of the contactless payment card used for payment.

For security reasons, the ticket distribution system does not store contactless payment card numbers, therefore complaints not containing the token are incomplete and impossible to resolve.

The submission must contain all necessary data, i.e., the contact details of the complainant, the date and time of the event, the place of the event (line number, vehicle), a description of the complaint, the token, and the possible amount.

Responses to complaints are provided, as per the Passenger's request, by email or traditional mail. A response is given without undue delay, within 7 working days from the date of receipt of the complaint.

Fares paid using the ticket validator are not subject to cancellation or refunds.

Disclaimers

§ 7

PGK reserves the right to temporarily suspend access to the fare payment service using the ticket validator for maintenance work. Information about the unavailability of the service will be published on www.pgk.suwalki.pl and skk.suwalki.pl.

PGK is not responsible for the non-performance or improper performance of obligations resulting from these Regulations, if the non-performance or improper performance of obligations is caused by circumstances beyond PGK's control despite exercising due diligence (force majeure) or solely due to the fault of the injured party or a third party. In the event of force majeure, the performance of the service will be suspended for a period equal to the duration of the force majeure event.

Personal Data Protection

§ 8

The administrator of Passengers' personal data, within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter referred to as GDPR, is PGK.

Passengers' personal data are processed by PGK in accordance with the provisions of applicable law, in particular GDPR, for the purpose of:

  • performing the service and documenting its execution,
  • handling complaints,
  • fulfilling legal obligations imposed on PGK,
  • notifying the Passenger about the payment status.

In connection with the provision of services, PGK collects the following personal data of Passengers:

  • first name and last name,
  • residential address,
  • date of birth/PESEL,
  • number of the document confirming personal data,
  • data of payment instruments used to access the service,
  • phone number.

The provision of personal data by the Passenger is voluntary but necessary for the performance of the service, and failure to provide this data may result in the inability to use it.

Final Provisions

§ 9

The Regulations and all their amendments are made available on the websites www.pgk.suwalki.pl and www.skk.suwalki.pl.

PGK will notify about any changes to the Regulations by publishing relevant information on the aforementioned websites.

PGK updates tickets and prices as they come into force based on local law provisions.
